Terms and conditions of sale (valid from June 05, 2024)
Art.1 : Désignation des termes
Nous entendons par « transports uniquement » la location d’autocar fait pour compte d’autrui avec ou sans prestations de services complémentaires.
Nous entendons par « voyage à forfait », la vente de packages comprenant au moins deux services, proposé à la vente individuelle par Funny Tours SRL.
Nous entendons par « souscripteur » toute personne qui commande un voyage à forfait.
Nous entendons par « client » toute personne qui commande un Transport Uniquement.
Art. 2 : Validité
Toutes commandes, de Transport uniquement et de Voyage à forfait, sont prises en compte lorsqu’un bon de commande est émis par écrit (envoyé par voie postale, mail ou fax) suite à une remise d’offre écrite ou téléphonique ou à une commande effectuée via une communication téléphonique, le site internet marchand, par mail, Messenger ou tout autre réseau social.
Pour tout Transport uniquement un bon pour accord ou une signature du client sur la remise d’offre fait office de bon de commande officielle y compris l’acceptation des conditions générales de vente. Le client reconnaît alors avoir été mis au courant en bonne et due forme des conditions générales de vente et clauses spéciales de vente.
En cas de commande de transport uniquement, la remise d’offre est valable 10 jours à compter de la date d’émission de celle-ci, sous réserve de disponibilité des véhicules au moment de la réservation.
Toute commande de Voyage à Forfait effectuée par mail, téléphone, site marchand, Messenger ou tout autre réseau social, ne nécessite pas de signature apposée, le seul fait de recevoir le bon de commande vaut acceptation de celle-ci et des conditions générales de vente. Le souscripteur reconnaît alors avoir été mis au courant en bonne et due forme des conditions générales de vente et clauses spéciales de vente.
Art.3 : Our offers for Transport only are always made without any commitment on our part. Our delegates, agents or representatives are not our representatives, and any promises or acceptances they may make are binding on us only after ratification by one of Funny Tours SRL's directors.
Art.4 : The subscriber and customer who gives an order for a Package Tour or a quotation agreement for Transport only is deemed to have the right to do so. He assumes, together with his principals or participants, full responsibility for this order. He/she acknowledges that he/she is of legal age at the time of booking. He/she also acknowledges that he/she is solely responsible for the entire order form as its subscriber and customer.
Art.5 : Terms of payment for Transport only
-For Transport only, all our invoices are payable in cash or on the due date stated on the invoice. In general, the due date is 10 days after the date of issue of the invoice (pro-forma invoices may be issued under the same title, right & conditions), these invoices may be issued 31 days before the binding date of the contract. Payment of these invoices may be required prior to the binding date of the contract or the binding date of the order. In the event that the invoice does not specify payment terms, payment must be made within 10 days of the invoice date.
Art.6 : Terms of payment for Package Tours
L’acompte de 30% doit nous parvenir dans les 7 jours à compter de la réception du bon de commande par le souscripteur (la commande s’annulera de plein droit en cas de non-paiement de l’acompte après ce délai de 7 jours). Le solde de la commande doit nous parvenir au plus tard 6 semaines avant la date du dit voyage. Une facture acquittée est émise lors de la réception du solde, c’est uniquement ce document qui vaut document de voyage. Le non-paiement du solde dans les 35 jours avant la date du voyage équivaut à une annulation pure et simple de la part du souscripteur, ce qui entraîne les frais d’annulation repris à l’article 10.
Tout bon de commande pour un voyage à forfait établi à moins de 07 jours de la date du voyage, pour autant que le voyage ne soit pas clôturé, devra être suivi simultanément du paiement intégral du montant total de la commande.
Tout bon de commande pour un voyage à forfait établi à moins de 06 semaines de la date du voyage, pour autant que le voyage ne soit pas clôturé, devra être suivi dans les 07 jours du paiement intégral du montant total de la commande.
Art.7 : All our invoices are deemed to be correct as soon as they are issued. Any disputes must be submitted by registered letter within 8 days of the invoice date.
Art.8 : In the event of non-payment of an invoice and failure to contest it, the entire invoice shall become immediately due and payable, and shall automatically bear interest at the legal rate, without prior notice of default, and shall be increased by a lump-sum payment of 15% to cover administrative costs, with a minimum of €75.
Art.9 : In case of dispute, only the courts of the judicial district of the headquarters of SRL Funny Tours are competent.
Art.10 : Cancellation conditions
In the event of cancellation of the order by the customer or subscriber (for Transport Only or Package Travel), the customer or subscriber must pay the following charges:
- Cancellation 14 days after the reservation date (date of the order form) and more than 90 days before the binding date of the contract or order, a handling fee may be claimed or retained up to a minimum of 30% of the total amount of the order or contract, with a minimum of €30 per order.
- Cancellation between 90 and 61 days before the binding date of the contract or order: the 45% deposit must be paid or will be retained directly.
- Cancellation between 60 and 46 days before the binding date of the contract: 65% of the total amount of the order or invoice must be paid or will be retained directly.
- Cancellation between 45 & 0 days before the binding date of the contract: 100% of the order or invoice amount must be paid or will be retained directly.
Any cancellation of an order paid by means of a voucher and for which a reimbursement by Funny Tours would be necessary, will be done by reactivating the said voucher in addition to any cancellation fees that may be deducted.
Art.11 : Conditions of modification or partial cancellation
In the event of modification (postponement of the date is not a modification) or partial cancellation of the order by the customer or subscriber, the latter must pay the following fees:
- Modifications or partial cancellations made more than 90 days before the contract or order is due to take effect may result in a handling fee of at least 15% of the total amount of the order or contract, with a minimum of 15 euros per order and per person modified.
- Less than 90 days before the binding date of the contract or order, if it can be carried out without modifying the total price of the order, no processing fee will be charged. Otherwise, a surcharge on the total amount of the order will be applied, claimed or withheld up to a minimum of 15% of the total amount of the order or contract, with a minimum of €15 per order and per person modified.
- For Package Tours, a minimum charge of €30 per person may be claimed for any changes made by the policyholder to the names of participants between the 14th day and 72 working hours prior to departure.
- Aucune modification de nom ne pourra plus intervenir à moins de 72 heures ouvrables avant le départ.
Pour les Voyages à Forfait, toute annulation partielle entrainera des frais de modification et/ou d’annulation et dans certains cas le recalcul du prix de base par personne.
In the event of modification or partial cancellation, the subscriber remains responsible for the entire order.
Art.12 : Cancellation of the trip by the organizer
L’organisateur se réserve le droit d’annuler un voyage lorsque, avant l’exécution de celui-ci, se manifeste un cas de force majeure, c’est-à-dire des circonstances d’un caractère exceptionnel que l’organisateur ne pouvait pas connaître au moment de la conclusion du contrat. L’organisateur remboursera, via un bon à valoir d’une validité minimum de 12 mois, dans ce cas la totalité des sommes versées par les voyageurs, pour autant que la commande soit en ordre de paiement, sans que ceux-ci puissent réclamer des dommages et intérêts éventuels. Le souscripteur renonce implicitement et de plein droit à tout remboursement monétaire pour l’ensemble de la commande.
L’organisateur se réserve aussi le droit de résilier le contrat sans indemnité lorsqu’un voyage ne peut s’effectuer par suite de participation insuffisante de voyageurs : vingt est le nombre minimum de participants nécessaires à l’exécution d’un voyage.
In this case, the traveller will have been notified in writing within the period provided for by law, i.e. :
- twenty days before the start of the package tour in the case of tours lasting more than six days;
- seven days before the start of the package tour for tours lasting between two and six days;
- quarante-huit heures avant le début du voyage à forfait dans le cas de voyages ne durant pas plus de deux jours
Art.13 : Règlement des plaintes
1. Avant le départ : Les plaintes antérieures à l’exécution du contrat de voyage doivent être introduites au plus vite par lettre recommandée contre accusé de réception, auprès de l’intermédiaire et/ou l’organisateur de voyages.
2. Pendant le voyage : Les plaintes qui surviennent durant l’exécution du contrat doivent être introduites au plus vite sur place, de manière appropriée et pour servir de preuves, afin qu’une solution puisse être recherchée. A cet effet, le voyageur s’adressera, dans l’ordre suivant, à un représentant de l’organisateur de voyages ou à un représentant de l’Intermédiaire de voyages, ou directement à l’intermédiaire de voyages, ou finalement, directement à l’organisateur de voyages.
3. Après le voyage : Les plaintes qu’il est impossible d’introduire sur place ou qui n’ont pas été résolues sur place de façon satisfaisante doivent être introduites au plus tard un mois après la fin du voyage auprès de l’intermédiaire ou, à défaut, auprès de l’organisateur du voyage, soit par lettre recommandée, soit contre accusé de réception.

Art 14 : All our package tours do not include cancellation insurance.
Art 15 : Fonds de Garantie Voyages
La S.R.L FUNNY TOURS est assurée conformément à l’article 3 de l’arrêté Royal du 29 mai 2018 relatif à la protection contre l’insolvabilité de la vente de voyage à forfait, de prestation de voyage liés et de services de voyage sous la référence 20.004/604/3018.
Art 16: 1. TRAVEL FORMALITIES
1.1 General information
When traveling abroad, you must always comply with the entry formalities required by the country you are visiting ('travel formalities'). And you alone are responsible for obtaining them.
For some countries, an identity card is sufficient, but this is not always the case. Other documents may be required:
- International passport: this is a burgundy booklet containing your identity details. This document must be requested from the Population Department in your place of residence.
- Visa: official authorization to stay in a country for a specified period of time. Depending on the country, visas must be applied for in advance at the embassy or consulate, or can simply be purchased on the spot.
- Vaccination certificate: vaccinations against certain diseases, such as coronavirus, yellow fever, meningitis, malaria, typhus or hepatitis, are compulsory in some countries. You may be refused entry if you are not in possession of a vaccination certificate. Ask your doctor or the relevant health authorities about the procedure to follow.
It is advisable to consult the embassy or consulate of the country visited for confirmation, to avoid unpleasant surprises. Any costs arising from changes in this area, such as an emergency procedure for obtaining a passport, are the responsibility of the traveler.
If your trip cannot go ahead or incurs additional costs because you have not fulfilled one of these obligations and travel formalities, we cannot be held responsible and/or bear any costs that may arise.
Special clauses appended to the general terms and conditions of sale for contracts of carriage only and including travel as part of Package Travel (including Conditions of Comfort, Safety and Special Conditions of Carriage) (Valid from April 02, 2020):
Art.1 : Any quotation, in order for there to be a contract of carriage only, must be the subject of written confirmation or agreement or signature on the said quotation within 10 days of the said quotation, subject to availability of coaches at the time of booking. This written confirmation will be treated as a purchase order, and the customer acknowledges that he has been duly informed of the general terms and conditions of sale and special sales clauses, otherwise we cannot guarantee the availability of the vehicle. This order form will be followed by a down payment of 30%.
Art.2 : Any modification of any kind whatsoever, for Transport only, must be requested in writing before the date on which transport is due to take place, and will be examined by the coach operator, who will then decide what action to take. In the event of a request being made at the time of or during the journey, the request must be presented to the driver(s), who will advise of the action to be taken.
Art.3 : Total ban on smoking in the coach (including the toilet).
Art.4 : Animaux
Dans les véhicules de l’entreprise Funny Tours, les animaux sont admis aux conditions suivantes : maximum 2 par véhicule, dans un panier de transport & moyennant une somme forfaitaire de 10 € par jour de transport par animal. Les suppléments demandés par nos prestataires sont à régler sur place.
Art. 5: One child = 1 seat, regardless of age. The number of available seats stipulated at the time of the prize-giving is the maximum capacity (number of seats) of the number of passengers accepted, as evidenced by the fact that wearing a seatbelt has become compulsory.
Art.6 : It is forbidden to sit, lie down or lie down in the central corridor of the coach, only to move towards the driver(s) or the toilet during the journey and when loading and unloading passengers.
Art.7 : For Transports Only, it will not be allowed to load beverages in the passenger area of the coach such as various alcohols, beer tubs, soft drinks, etc...
Art.8 : For Transport Only trips, meal stops are scheduled during the journey, so it is not permitted to eat on board the coach unless otherwise agreed in writing and accepted by our transport company. For Transport Only and Package Tours, only the driver will make the necessary arrangements regarding the duration and times of comfort stops, in compliance with current legislation.
Art.9 : It is forbidden to load illicit or illegal products such as drugs, narcotics, etc., either in the passenger area or in the holds. The transport company cannot be held responsible in the event of a check by the competent authorities.
Art.10 : Any damage or deterioration of any kind to the coach will be billed to the customer or subscriber.
Art.11 : It is recommended to use plastic bags as garbage cans. These are provided for this purpose. They are attached to the central armrests and are renewed in due course by the on-board staff or driver(s).
Art.12 : In the event of non-compliance with the above rules, the driver(s) may take any measures necessary to ensure smooth transport.
EXCLUSION: Any traveller who behaves in a way that compromises the smooth running of the trip or seriously inconveniences other travellers may be excluded from continuing the trip or stay. Any resulting costs will be borne by the traveler, who will not be entitled to a refund of all or part of the cost of the trip.
Art.13 : Il est signalé qu’en cas de retour précoce en Belgique du lieu de séjour ou de destination, du au fait de l’organisateur du programme ou de l’organisateur du voyage ou d’un de ses participants, aucune indemnité ne pourra être réclamée, il en est de même pour les kilomètres non-parcourus et prévus dans le forfait kilométrique.
Art.14 : Tout voyageur, quel qu’il soit, devra être muni de ses documents d’identité valable dans le pays de destination ou tout autre pays traversé pour arriver à la destination finale. En cas de non-respect de cet article, tout contrevenant prendra en charge les frais éventuels, liés à un contrôle par les autorités compétentes.
Le port de la ceinture de sécurité est obligatoire dans tous nos véhicules et à toutes les places, en cas de non-respect et lors d’un contrôle par les autorités compétentes, le voyageur prendra à sa charge l’amende infligée.
Art.15 : Tipping the driver is not compulsory and is left to the passenger's discretion.
Art 16 : We are committed to complying with the 561/2006 working regulations for drivers; in this respect, the driver(s) are obliged to respect them during transport. If, due to this fact, a change should occur during transport, we cannot be held responsible for the consequences of this change.
Art.17 : For Transport Only: if the number of kilometers is exceeded during the execution of the contract, these extra kilometers will be invoiced at the price of 2.50 € per additional kilometer.
Art.18 : For Transport only : the price fixed in the quotation will remain fixed only if the price of diesel fuel remains fixed or if any increase does not exceed 5% of the current price per liter between the date of the quotation and the date of execution of the transport. If this is not the case and if the price of diesel fuel increases by more than 5% of the current price per liter, a lump sum of €125 will be invoiced in addition per principal journey. In the event of a reduction in the price of diesel fuel, the price quoted in the quotation will remain fixed.
Art 19 : All persons entering the vehicle must be in possession of their legal identity documents for sales services at the time of registration. In the case of transport for a group, the person in charge of the group will bear full responsibility in the event of an inspection. The Carrier cannot be held responsible for the loss, theft or absence of these documents during an inspection. The driver or crew reserves the right to ask for a waiver acknowledging the above information.
Art.20 : It is totally forbidden for persons present in the vehicle to have in their possession and to use in any way whatsoever, illicit and illegal products. The Carrier cannot be held responsible for any goods that may be present in the hold or hand luggage belonging to persons in the vehicle.
Art 21 : The carrier cannot be held responsible for any loss, theft or damage that may occur during the transport of goods and valuables, whether in the driver's compartment, the cabin, the bunkers or any other part of the vehicle.
